1. Acceptance of Terms
By accessing or using custodial.fail ("Platform", "Service", "we", "us", or "our"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Service. We may update these Terms at any time; continued use constitutes acceptance of changes. Users are responsible for reviewing Terms periodically.
2. Description of Service
custodial.fail provides a non-custodial aggregation interface connecting users to third-party cryptocurrency swap and exchange providers ("Providers"). The Platform compares rates, facilitates Provider selection, and initiates transactions via Provider APIs.
We do not execute trades, hold funds, or process payments. All cryptocurrency transactions occur directly between users and Providers. The Service supports various digital assets but relies entirely on Provider availability and compliance.
custodial.fail operates as a technology-neutral intermediary with no control over Provider operations, including transaction speed, success rates, fees, or asset recovery.
3. User Eligibility and Responsibilities
You must be at least 18 years old and legally competent to use the Service. You represent that you will comply with all applicable laws, including anti-money laundering regulations and sanctions.
Users are solely responsible for:
- Verifying wallet addresses and transaction details before confirmation.
- Understanding Provider terms, fees, and limitations.
- Securing private keys and authentication credentials.
- Any tax, regulatory, or compliance obligations arising from transactions.
Prohibited activities include fraud, money laundering, sanctions evasion, or using the Service for illegal purposes. We reserve the right to block access without notice.
4. Data Collection and Privacy
custodial.fail adheres to a strict minimal-data policy. No personal information is collected or stored beyond what is strictly necessary for Service operation:
- User-provided data: Wallet addresses, amounts, and transaction parameters entered during swaps.
- Provider data: Information transmitted by Providers during API interactions (e.g., quotes, transaction IDs).
- Technical logs: nginx-generated access logs capturing IP addresses, user agents, timestamps, and request paths for security and debugging.
No analytics, cookies, tracking pixels, or behavioral data are implemented. No secret persistent identifiers exist. Data is not shared with third parties except as required by Providers for transaction completion or by compulsory legal process.
Logs are retained only as long as operationally necessary and securely deleted thereafter. As a private entity, we disclose no internal data absent legal compulsion.
5. Non-Custodial Nature and Asset Ownership
custodial.fail does not custody, hold, manage, transfer, or own any cryptocurrency or digital assets. All assets originate from user wallets and are routed directly to Providers. We exercise zero control over funds at any stage.
Users bear full risk of Provider insolvency, hacks, errors, or failures. The Platform disclaims any fiduciary duty or trusteeship.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee:
- Provider availability, accuracy of rates, or transaction success.
- Security of Provider platforms or user endpoints.
- Compatibility with specific wallets or networks.
To the maximum extent permitted by law, custodial.fail, its affiliates, and personnel shall not be liable for indirect, incidental, consequential, or punitive damages—including lost profits, data loss, or cryptocurrency value fluctuations—arising from Service use. Direct liability is capped at zero USD.
You indemnify us against claims arising from your transactions, Provider interactions, or regulatory violations.
7. Termination and Modifications
We may suspend, terminate, or modify the Service at any time without liability or prior notice. Upon termination of access, these Terms survive for unresolved matters.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Singapore, Singapore. Users consent to personal jurisdiction there.
9. Miscellaneous
These Terms constitute the entire agreement. No waiver is effective unless written. If any provision is invalid, others remain enforceable. Force majeure events excuse performance.
